HHS Notifies Iowa Approving External Review Process

Process recognized as meeting federal ACA requirements

(DES MOINES) July 29, 2011 – The Department of Health and Human Services today notified the Iowa Insurance Division that Iowa’s process for external review in health insurance meets their standards, as established under the Affordable Care Act.

Iowa has had an External Review process since it was originally enacted from a National Association of Insurance Commissioners (NAIC) model act in 2000. The NAIC updated the model to broaden the scope of its use in 2010, consistent with the provisions in the federal law.  Iowa’s legislature passed that updated model in the 2011 session.  It was signed into law by Governor Branstad in April and has been in effect since July 1.

“We’re pleased that we have received the affirmation that we are on track with current laws and regulatory practices,” Iowa Insurance Commissioner Susan Voss said. “Iowa has consistently been among the leading states in the adoption of laws that work well for the benefit of consumers.  The new External Review law passed this year will provide important new tools in assuring fairness and responsiveness by the insurance industry as they meet their obligations under the policies they sell.”
