The Iowa Insurance Division regulates the sale of viatical settlements. Viatical settlement providers purchase viatical settlement contracts and provide the viator a sum of money in consideration for a life insurance policy.
A viatical settlement provider must be licensed by the Iowa Insurance Division by completing the Viatical Settlement Provider License Application. A viatical settlement provider must renew its license every three years by completing the same application.
Viatical settlement providers must submit an annual statement required by the Iowa Insurance Division by March 1 of each year per the instructions in Iowa Code Section 508E.6 and Iowa Administrative Code rule 191-48.7.
A viatical settlement provider must provide the Iowa Insurance Division with up-to-date information about officers, ten-percent-or-more stockholders, partners, directors, members, or designated employees within thirty days of a change.
The Iowa Insurance Division has implemented a new electronic process for filing applications, renewals, and annual reports for Viatical Providers. Effective for 2021 all viatical provider submissions MUST be submitted electronically via OPTins. The Iowa Insurance Division will NOT accept any paper renewal, application, or annual report forms unless prior approval is received. Before you are able to submit your submissions, you must create an OPTins account. Creating an OPTins account takes about 10 business days.
Creating an OPTins Account
OPTins is a simple three-step process which facilitates the electronic submission of premium taxes, surplus lines taxes and state-specific filings. Fees are transmitted via ACH debit or ACH credit, to assure that your funds will be received by the state in a timely and secure manner. There is no special software to purchase or licensing fees - only a transaction fee per filing.

If you would like to utilize ACH credit, please click on the previously mentioned link and complete the Implementation Forms - All Other (ACH Credit). Please note, ACH Credit is not a credit card. OPTins does not accept credit card payments. Once your paperwork is completed, please email the completed account forms to optinsmktg@naic.org. We will then begin the implementation process. Account setup takes about 7-10 business days.
Creating a Filing in OPTins
Once you have created an account, please create a filing for the current filing year, filing type is “Renewals Reports and Applications”, select your filing entity, entity type will be “Viatical Provider”, and the filing period will be “VSP Annual Report” for annual reports and “VSP New or Renewal” for applications and renewals. You then will be prompted to download the corresponding form. Please complete the form and save it to your computer before uploading them. You must label all exhibits before uploading them into OPTins.
If you need to make any changes to your filing please amend your filing and upload the corrected documents. This will ensure that the filing is edited and no duplicate filings are received.
Filing of Forms
If a viatical settlement provider subsequently desires to change the viatical settlement contract documents or disclosure statements approved at the time of licensure, or to use new ones, the provider shall submit the new or modified contract documents or disclosure statements to the commissioner via OPTins by amending the annual report and uploading the updated forms. The viatical settlement provider shall identify its name and address in the cover letter and also reference the form name of the modified viatical settlement contract document or disclosure statement. Black-lining the modifications made within the document(s) should expedite the form review and approval process.
